Abstract:
The article examines the interaction between the institutions of the European Union and the Member States with regard to the control of state aid. Based on a database covering all applications for public assistance with regulations between 20XX and 20XX, it is shown that, on the one hand, the Commission tends to reject programs originating from countries that resist EU integration, as evidenced by the lack of transposition. On the other hand, when firms or national governments challenge decisions made by the Commission, the rejection of the Commissions decisions rejected by the Court of Justice of the European Union is positively correlated with a lack of transposition.
