Abstract:
The year 2020, an extraordinary one from any point of view, witnessed a turning point in the debate about market dynamics in the digital economy—and what to do about them. Perhaps, it is fair to say that this is not so much a coincidence but a consequence of the digitisation boost forced by lockdowns and remote working obligations, further inflating the market value of a handful of tech giants and magnifying their economic and social impact. The multitude of studies, economic, and legal analyses as well as investigations of possible abuses in digital markets carried out in the past 20 years, often around the same digital businesses, blossomed into actual regulatory stances around the world. Across jurisdictions we observe a generalised realisation that market forces are not going to correct by themselves the most egregious issues observed in the digital domain and therefore a growing sense of urgency for regulators to deal with the increasing economic and informational power of the biggest online platforms and their undesirable consequences from a public policy perspective.
